The website at www.signaturemarket.co (“Site”) is owned and operated by Signature Market Sdn. Bhd. (“Signature Market”, “Company”, “we”, “us”, or “our”).

The Company markets, sells, and delivers packaged food products directly to customers through its online platform and retail channels.

Certain features, services, or promotions available on the Site may be subject to additional terms, conditions, guidelines, or rules, which will be made available on the Site. Such additional terms shall form part of these Terms & Conditions and shall be binding on you.

By accessing the Site and/or placing an order with us, you agree to be bound by these Terms & Conditions.

You represent and warrant that:
  • You are at least 18 years of age, or accessing the Site under the supervision of a parent or legal guardian
  • You have the legal right, authority, and capacity to enter into a binding agreement (whether on your own behalf or on behalf of an entity you represent)

If you do not agree to these Terms & Conditions, you should not access or use the Site.

1. DEFINITION:

In these Terms & Conditions, the following terms shall have the meanings assigned to them below:

“Account” means a registered Signature Market customer account created on the Site or Mobile Apps.

“Customer” means any individual who places an Order via the Site or Flagship Store, or participates in any of the Company’s campaigns, promotions, or activities.

“Order” means a request submitted by you through the Site, Mobile Apps, or Flagship Store to purchase product(s) from the Company.

“You” / “Your” means the Customer placing an Order or participating in any campaign, promotion, or activity.

“Flagship Store” means any official Signature Market retail outlet operated by the Company.

“Mobile Apps” means the mobile applications operated by Signature Market that enable customers to browse products, place orders, track deliveries, manage store credit, and access promotions, subject to these Terms & Conditions.

Words imparting the singular shall include the plural and vice versa. Words imparting a gender shall include every gender and references to persons shall include an individual, company, corporation, firm or partnership; References to "includes" or "including" or like words or expressions shall mean without limitation.

2. PRICE AND PAYMENT:

2.1 Where applicable, prices are in Malaysian Ringgit (RM) unless otherwise specified. Delivery fees and any applicable charges will be clearly displayed at checkout and included in the ‘Grand Total’ before payment is completed.

2.2 A minimum order value of RM30 applies to all purchases made via the Website, across all customer types and membership tiers.

2.3 You may order any of the product(s) offered (including without limitation, a la carte or gift) by following the purchase process provided on the Website / Flagship Store.

2.4 We accept payment through our approved payment partners as listed on the Website or at the Flagship Store. Orders may be paid in full or partially using Store Credit or Promotional vouchers (where applicable).

2.5 Once an Order has been processed for fulfilment, amendments may no longer be possible. Customers may contact our Customer Care Team to request changes prior to processing. While we will make reasonable efforts to assist, all requests are subject to operational feasibility.

2.6 We shall not be held responsible/ liable for any products ordered from other channels/ methods aside from the Site / Flagship Store.

2.7 All orders made for clearance items are non-refundable and non-exchangeable.

2.8 Free gift that comes with your Order will be shown in the shopping cart or the point of sale system (if any).

2.9 Free gifts are subject to stock availability.We reserve the right to substitute free gifts with items of equal value where necessary

2.10 All free gifts are non-refundable, non-exchangeable, subject to availability and first come first served basis.

2.11 Errors & Inaccuracies

We strive to ensure that all information on the Site is accurate. However, errors may occur, including pricing errors, product descriptions, or availability.

We reserve the right to: - Correct any errors or inaccuracies - Cancel or refuse any Order placed based on incorrect information

If payment has been made, a full refund will be processed accordingly.

2.12 Right to Refuse Orders

We reserve the right to refuse, cancel, or limit any Order at our sole discretion, including but not limited to:
  • Suspected fraudulent transactions
  • Abnormal or bulk purchasing behaviour
  • Errors in pricing or product information

3. ORDER OR PRODUCTS COMPLAINTS:

3.1 Order Errors (Packing Issues)

Should there be error in your Order due to packing issues (i.e. missing product/ incorrect items received), please notify our Customer Care Team within 7 days from the date of delivery via the QR code provided on the Delivery Order or using the Request Refund function on our Website or Mobile Apps. All claims will be subject to verification. Claims submitted after 7 days from the date of delivery will not be accepted.

3.2 Product Quality Issues

If you encounter any issues relating to product quality (e.g. spoiled items, expired products), please contact our Customer Care Team within 30 days based on the following:
  • Online Purchases: Within 30 days from the date of delivery
  • Flagship Store Purchases: Within 30 days from the date of purchase (with original receipt required)

You may submit your request via:
  • The QR code provided on the Delivery Order / receipt, or
  • The Request Refund function on our Website or Mobile App

All claims will be subject to verification. Claims submitted after the applicable timeframe will not be accepted.

3.3 Damaged Items (Delivery-Related)

If you receive items that are damaged during delivery, please notify our Customer Care Team within 7 days from the date of delivery.

You may submit your request via:
  • The QR code provided on the Delivery Order, or
  • The Request Refund function on our Website or Mobile App

All claims will be subject to verification. Claims submitted after 7 days from the date of delivery will not be accepted.

4. REFUND POLICY

4.1 Refunds from returned items will only be processed once we have received the physical return parcel and a quality inspection has been completed to assess the condition of the item. Once the processing is completed, the equivalent amount will be credited based on the following payment method. Unless otherwise required by law, refunds may be issued in the form of Store Credit or the original payment method, at the Company’s discretion.

4.2 All returned items must be sent in their original condition, including original packaging. We reserve the right to reject any return that is damaged, used, or incomplete, or fall outside of the 30 days return window.

4.3 All refunds are subject to verification and will be processed in accordance with the terms stated in Section 4.1.

4.4 Exchanges are not available at the Flagship Store. All exchange requests must be submitted through our Customer Care Team within the applicable return period.

4.5 Return Window
  • For online purchases - within 30 days from the date of parcel delivery
  • For Flagship Store purchases - within 30 days from the date of purchasing, with original receipt required.

5. PROCESSING YOUR ORDER:

5.1 Order Processing & Delivery

Orders are typically processed within two (2) to three (3) working days (excluding weekends and public holidays). We will make every reasonable effort to deliver your order within the estimated timeframe provided at checkout and stated in your Order Confirmation email. However, delivery timelines may vary depending on location, order volume, and external factors.

5.2 Delivery Delays

In the event of any delay, we will notify you as soon as reasonably possible.

While we strive to meet all delivery timelines, delays may occur due to circumstances beyond our control (e.g. courier disruptions, peak periods, weather conditions). To the extent permitted by law, we shall not be liable for any losses, damages, or costs arising from such delays.

5.3 Courier Partners

Orders are fulfilled and delivered via our appointed courier partners, including but not limited to:
  • Ninja Van
  • DHL eCommerce
  • Pos Laju (Malaysia)
  • City-Link Express

We reserve the right to assign the most suitable courier partner for each order.

5.4 Self-Collection

Self-collection from our warehouse or Flagship Store is not available at this time.

5.5 Failed Delivery & Returned Parcels

Parcels may be returned to us under the following circumstances:
  • Incorrect, incomplete, or invalid delivery details provided, or
  • Unsuccessful delivery after two (2) delivery attempts by the courier

If a parcel is returned to us, we will process a refund in the form of Store Credit. Customers may request an alternative refund method (e.g. original payment method), which will be reviewed on a case-by-case basis.

5.6 Out-of-Stock Items

If an item becomes unavailable after your Order is placed, we will notify you where reasonably possible and process a refund for the affected item(s).

Refunds shall be processed automatically and issued in the form of Store Credit. Alternative refund methods may be requested and shall be subject to the Company’s approval and reviewed on a case-by-case basis.

5.7 Risk & Title

Risk of loss or damage to products passes to you upon successful delivery to the address provided.

6. DELIVERY FEE:

6.1.2 East Malaysia & selected rural areas ( West Malaysia*):
  • For Orders between RM30.00 - RM49.99: Additional RM35.00 logistic surcharge + RM10.00 shipping fees
  • For Orders between RM50.00 – RM99.99: Additional RM35.00 logistic surcharge + RM5.00 shipping fees
  • For Orders RM 100.00 & above: Additional RM 35.00 logistic surcharge

*Delivery availability is subject to courier service coverage and location accessibility.

6.1.3 Kuala Lumpur warehouse to Singapore:
  • Standard logistic surcharge of RM30.00 per order

6.1.4 Same Day Delivery (Klang Valley Only)

6.2 Platinum Members are entitled to unlimited free shipping, excluding any applicable logistic surcharges.

6.3 Delivery fees, surcharges, and courier arrangements may be updated from time to time. The applicable charges will be reflected at checkout prior to payment.

7. PROMOTION:

7.1 Promotional offers may differ between new customers and existing customers, as determined by the Company from time to time.

7.2 Promotions designated for new customers are not applicable to existing customers, and vice versa. Each promotion is subject to its own specific terms and conditions.

7.3 For existing customers to enjoy promotion of purchase above RM200.00 / RM400.00 / etc must be in single receipt. Combinations of receipts are not allowed.

7.4 Terms and conditions for specific promotions (especially for new customers) will be displayed within the relevant campaign interface (e.g. pop-up window or landing page). Customers are deemed to have checked the information needed or related to the promotion(s), reviewed, understood and agreed to the terms and conditions provided upon clicking “redeem now”.

7.5 All promotions are subject to their respective validity periods and specific terms. Promotions are non-transferable, non-exchangeable for cash, and may not be reused once redeemed

7.6 Promotion Priority

Where multiple promotions are available, the system will apply the most relevant promotion based on predefined rules. Promotions cannot be combined unless expressly stated. In the event of conflict, the Company’s system determination shall be final.

7.7 Multiple promotions may be held simultaneously within the same period of time. However, combining multiple promotions in single purchase is not allowed unless specify otherwise.

7.8 New customers may enjoy an additional 20% discount on their first purchase via the website with maximum discount capped at RM100. Only Applicable to first purchase only.

7.9 Customers who redeem a first-time retail promotion are entitled to:
  • 20% discount, capped at RM100
  • Valid for one-time use per account only
  • Voucher must be redeemed within 7 days from the date of QR code scan

Unredeemed vouchers after the validity period will be automatically forfeited and the Company shall not be obliged to honour, reinstate, or extend the validity period under any circumstances whatsoever.

7.10 The Purchase With Purchase (PWP) promotion offers customers the opportunity to buy an additional item at a discounted price. PWP items are treated independently and cannot be combined with your current cart purchase to avail free gift promotions, free delivery offers, birthday discounts and other promotions.

7.11 Orders should not be modified, cancelled, or recreated for the purpose of obtaining additional promotional benefits. Where unusual or abusive activity is detected, the Company reserves the right to review and take appropriate action, including cancellation of affected orders.

7.12 Items shown in snack pack, gift box, bundle are for illustration purposes only. Decorative items and props are not included unless explicitly stated.

7.13 Birthday Rewards are generated based on the Signature Market VIP membership tier (refer to Appendix).

7.14 Birthday Rewards are only applicable to customers who have updated their personal info including date of birth in Account prior to their birthday month. Once data of birth is submitted, no amendments are allowed. Birthday Rewards are valid within the customer’s birthday month and are limited to one-time use per year.

If an order using Birthday Rewards is cancelled or not successfully completed, the reward will be considered utilised and may not be reissued, except at the Company’s discretion in exceptional circumstances.

7.15 VIP Cash Back is a form of Store Credit earned as a percentage of the final amount paid for each completed order, based on the customer’s Signature Market VIP membership tier. Every membership tier is entitled to a Store Credit percentage of VIP Cash Back (refer to Appendix)

7.16 See Café Food & Beverage Discount

VIP members are entitled to Food & Beverage discounts at See Cafe (Arcoris Mont Kiara and The Gardens Mall) based on their Signature Market VIP membership tier (refer to Appendix). This discount is valid for food and beverage only (dine-in and takeaway). It does not apply to the purchase of retail products.

7.17 The Slimjoy Food & Beverage Discounts are offered based on the Signature Market VIP membership tier (refer to Appendix). This discount is not applicable in conjunction with any other in-store or ongoing promotions. In the event of overlapping promotions, other promotions will take precedence, and the Slimjoy tier-based discount will not apply.

7.18 We reserve the right to Amend, modify, or withdraw any promotion, marketing activity, or campaign at any time. Make the final decision on all matters relating to promotions.

All decisions made by the Company shall be final and binding.

8. AFFILIATE :

8.1 New Customer Affiliate

8.1.1 Affiliate rewards are granted only for the first completed purchase made by a newly registered customer using your unique affiliate link.

8.1.2 You will receive RM10.00 in Store Credit for each successful and validated referral purchase, unless otherwise specified under a particular campaign or promotion.

8.1.3 Each successful affiliate transaction is subject to a validation process to ensure that all information from the referred customer is new and has not been previously registered in our system. No duplicate, fraudulent, or invalid accounts are involved.

8.2 Product Affiliate

8.2.1 Product Affiliate rewards are granted only for successful and completed product purchases made by a customer using your unique affiliate link.

8.2.2 You will receive Store Credit for each successful and validated referral purchase, based on the commission rate stated for the respective product and quantity purchased, unless otherwise specified under a particular campaign or promotion.

8.3 All affiliate rewards are subject to the applicable terms and conditions of the Affiliate Program, as determined by the Company from time to time.

8.4 We have the sole and absolute discretion to withhold, revoke or cancel any pending or credited affiliate rewards in the event you failed to comply with the terms and conditions of the reward credit affiliate programme.

8.5 Affiliate rewards are calculated on a monthly basis and will be credited to your account by the 10th day of the following month, subject to successful validation.

8.6 Referral Program Abuse Prevention:

Signature Market is committed to maintaining a fair and transparent Referral Program for all participants. To protect the integrity of the program, we reserve the right to review, withhold, or revoke referral rewards where misuse, abuse, or fraudulent activity is suspected.

This includes, but is not limited to:
  • Creating multiple accounts using different contact details that are linked to the same individual, household, device, or delivery address
  • Self-referrals through alternate email accounts, phone numbers, or other means
  • Coordinating with others to artificially generate referral rewards or manipulate referral outcomes
  • Any activity deemed inconsistent with the intended purpose of the Referral Program

If such activity is detected, we reserve the right to take appropriate action, including:
  • Withholding or cancelling referral rewards
  • Disqualifying users from participating in the Referral Program
  • Suspending or terminating associated accounts

These actions may be taken without prior notice where necessary to protect the program’s integrity.

9. STORE CREDIT:

9.1 Store Credit is valid for 12 months from the date of issuance, unless otherwise specified under a particular promotion or campaign.

9.2 Store Credit must be used within the validity period stated in your account. Any unused store credit will be automatically forfeited upon expiry. Expired store credit is non-recoverable and cannot be reinstated.

9.3 Store Credit must be used within its validity period. Once expired, it will no longer be available for use and cannot be reinstated.

We encourage customers to monitor their Store Credit balance and expiry via their Account.

9.4 Store Credit is non-transferable and cannot be resold or assigned to another account

9.5 Store Credit cannot be exchanged for cash, refunded, or withdrawn at any time

9.6 Where an Order is cancelled or refunded, any Store Credit used or earned in relation to that Order may be reversed or adjusted accordingly.

10. CONTEST

10.1 Organiser & Eligibility

All contests are organised by Signature Market Sdn. Bhd. [1416668-A] (“Organiser”).

Participation is open to:
  • Malaysian residents aged 18 years and above
  • With a valid Malaysian address

The following are not eligible:
  • Employees of the Organiser (including related/affiliated companies) and their immediate family members
  • Representatives, agents, or service providers involved in the contest and their immediate family members

10.2 Contest Period
  • Each contest will run within a specified period (“Contest Period”)
  • Entries submitted outside the Contest Period will be disqualified
  • The Organiser reserves the right to amend the Contest Period at any time

10.3 Entry & Participation
  • Participation criteria and submission steps will be specified in the relevant campaign post or announcement
  • Participants must comply with all instructions to qualify

10.4 Prizes & Redemption

(a) Online / Social Media Contests
  • Winners must contact the Organiser via the respective platform (e.g. Facebook, Instagram)
  • A winner form must be completed with accurate and complete details
  • Incomplete or inaccurate submissions may result in disqualification
  • Prizes will be credited to the winner’s Customer Account and delivered together with an Order
  • Unclaimed prizes within the specified period will be forfeited

(b) Physical Prize Collection (if applicable)
  • Prizes must be collected at the designated location by the winner or authorised representative
  • Identity verification and required forms must be completed
  • Collection is valid for one (1) month, during working hours (excluding public holidays)
  • Uncollected prizes will be forfeited

General Prize Terms
  • Prizes are non-transferable, non-exchangeable, and non-redeemable for cash
  • The Organiser reserves the right to substitute prizes with items of similar value

10.5 Costs & Liability

  • All costs incurred in participating in the contest or redeeming prizes (e.g. transport, accommodation) are borne by the participant

10.6 Rights of the Organiser

The Organiser reserves the right to remove content, disqualify participants, and take legal action where necessary.

10.9 Amendments

The Organiser reserves the right to amend these terms at any time. Continued participation constitutes acceptance of the updated terms.

10.10 Limitation of Liability

To the extent permitted by law, the Organiser shall not be liable for any indirect or consequential losses arising from participation in the contest.

10.11 Health Disclaimer

Participants with medical conditions or allergies should seek professional advice before consuming any products. The Organiser shall not be responsible for any consequences arising from such conditions.

10.12 Governing Law

These terms are governed by the laws of Malaysia, and participants agree to submit to the exclusive jurisdiction of Malaysian courts.

10.13 Notices

Notices may be communicated via your registered email address. You are responsible for keeping your contact details updated.

11.1 Account Creation

Registration of a Signature Market Account may be required to access certain features, promotions, or campaigns on the Site or Mobile Apps.

By creating an Account, you represent and warrant that:

  • You will maintain and promptly update your information where necessary

You may request to deactivate or delete your Account at any time by following the instructions on the Site or by contacting our Customer Care Team.

11.2 Account Responsibilities

You are responsible for maintaining the confidentiality and security of your Account credentials.
  • All activities conducted under your Account are deemed to be authorised by you

To the extent permitted by law, Signature Market shall not be liable for any loss or damage arising from unauthorised use of your Account.

11.3 Promotional emailsAs an Account user/member, you agree to receive newsletters and promotional materials, marketing communications including third party offers from us. You may opt out of such communications at any time via the unsubscribe function or by contacting us.

11.4 PDPA Consent ClauseBy creating an Account, you consent to Signature Market collecting, using, storing, and processing your personal data in accordance with applicable laws, including the Personal Data Protection Act 2010 (PDPA).

Your personal data may be used for purposes including:
  • Account management and service delivery
  • Customer support and communication
  • Marketing, promotions, and updates

We may disclose your personal data:
  • To relevant authorities where required by law

12. SITE

Subject to these Terms & Conditions, Signature Market grants you a limited, non-transferable, non-assignable, non-exclusive, and revocable licence to access and use the Site for your personal, non-commercial use only.

12.2 Restrictions

The licence granted to you is subject to the following restrictions. You shall not:

  • 12.2.1 License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Site
  • 12.2.2 Modify, create derivative works of, disassemble, reverse compile, or reverse engineer any part of the Site
  • 12.2.3 Access or use the Site for the purpose of developing a competing product or service
  • 12.2.4 Copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Site in any form or by any means, except as expressly permitted under these Terms & Conditions

12.3 Modifications to the Site

12.4 Support & Maintenance

Signature Market may, at its discretion, provide support, updates, or maintenance for the Site. However, nothing in these Terms & Conditions shall be construed as an obligation for the Company to provide any such support, updates, or maintenance at any time.

12.5 Ownership & Intellectual Property

Except for any content submitted by you (“User Content”):
  • All intellectual property rights in the Site, including but not limited to copyrights, trademarks, patents, and trade secrets, are owned by Signature Market or its licensors
  • Nothing in these Terms & Conditions shall transfer any ownership rights to you
  • You are granted only the limited licence to use the Site as set out in Clause 12.1

13. USER CONTENT

13.1 User Content

13.1.1 Definition “User Content” means any information, data, or material that you submit, upload, or make available through the Site (including profile information, reviews, or other content).

13.1.2 Responsibility You are solely responsible for your User Content and all consequences arising from it, including any reliance placed on its accuracy, completeness, or legality.

13.1.3 Compliance

You represent and warrant that your User Content:

13.1.4 No Endorsement

13.1.5 Storage & Deletion Signature Market is not obligated to store, back up, or maintain any User Content. We reserve the right to remove or delete User Content at any time without prior notice. You are responsible for retaining your own copies.

13.2 Feedback

By submitting any suggestions, ideas, or feedback to Signature Market:
  • 13.2.1 You confirm that such feedback is non-confidential and non-proprietary
  • 13.2.2 The Company has no obligation of confidentiality in respect of such feedback
  • 13.2.3 The Company may use, reproduce, modify, or disclose such feedback for any purpose, without restriction

  • 13.3.10 Introduce viruses, malware, or harmful code

Platform Misuse

You further agree not to:
  • 13.3.11 Copy, reproduce, distribute, or commercially exploit any part of the Site without permission
  • 13.3.12 Reverse engineer, decompile, or attempt to extract source code
  • 13.3.13 Use the Site or its data to build competing services
  • 13.3.14 Resell or transfer access to the Site or its services
  • 13.3.15 Remove or alter any intellectual property notices

  • 13.3.17 Interfere with the Site’s functionality or security

14. INDEMNITY

You agree to indemnify, defend, and hold harmless Signature Market Sdn. Bhd. (the “Company”), including its directors, officers, employees, agents, and affiliates, from and against any and all claims, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
  • 14.1 Your use of the Site, Mobile Apps, or services
  • 14.2 Any content, information, or materials submitted or shared by you (“User Content”)
  • 14.3 Your breach or violation of these Terms & Conditions
  • 14.4 Your breach of any applicable laws or regulations

The Company reserves the right, at your expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

You agree to:
  • Cooperate fully with the Company in the defence of such claims
  • Not settle or compromise any claim without the Company’s prior written consent

The Company will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

  • Any acts or omissions of such third parties

16. LIMITATION ON LIABILITY

To the fullest extent permitted by applicable law, Signature Market Sdn. Bhd. (including its directors, officers, employees, agents, affiliates, and suppliers) shall not be liable to you for any:
  • Loss of profits
  • Loss of revenue or business
  • Loss of data or goodwill
  • Indirect, incidental, consequential, special, exemplary, or punitive damages

arising out of or in connection with:
  • Your use of, or inability to use, the Site, Mobile Apps, or services
  • Any transaction between you and the Company

To the extent permitted by law, the total aggregate liability of the Company for any claim arising out of or in connection with these Terms & Conditions or your use of the Site shall not exceed the total amount paid by you for the relevant Order giving rise to the claim.

Nothing in this clause shall limit or exclude any liability that cannot be excluded under applicable law.

17. TERM AND TERMINATION17.1 Binding Effect

By accessing or using the Site, you agree to be bound by these Terms & Conditions for the duration of your use.

17.2 Suspension or Termination
